1. Overview

WeSwarm (“the Installation,” “we,” “us,” or “our”, also known as WeTotallySwarm) is an interactive art installation that uses the Instagram Graph API to display selected Instagram content as part of a real-time visual artwork experience.

WeSwarm respects your privacy and is committed to protecting personal information in accordance with applicable privacy laws and platform requirements.

This Privacy Policy explains what information we collect, how we use it, and your rights regarding your data.

2. Information We Collect

WeSwarm may process the following types of information via the Instagram Graph API:

  • Public Instagram profile information (e.g., username, profile picture)
  • Public media (images, videos, captions)
  • Media metadata (timestamps, like counts, comments count)
  • Hashtag-related public content (if applicable)
  • Instagram Business or Creator account data (if authorized)

WeSwarm does not collect private Instagram data, passwords, direct messages, or non-public content.

WeSwarm does not independently collect sensitive personal data.

3. How We Use Information

We use Instagram data solely to:

  • Display public Instagram content within the WeSwarm art installation
  • Generate real-time or curated visual compositions
  • Operate, maintain, and improve the installation
  • Comply with Instagram Platform Policies

We do not:

  • Sell personal data
  • Share personal data with third-party marketers
  • Use data for advertising purposes
  • Store data longer than necessary for artistic display purposes

4. Legal Basis for Processing (If Applicable)

Where required under applicable laws (e.g., GDPR), our legal basis for processing public Instagram data includes:

  • Public content retrieved via the Instagram Graph API may be cached temporarily for performance purposes.
  • Cached data is retained only as long as necessary for operational or artistic purposes.
  • We do not maintain long-term archives of personal data unless explicitly required for the installation’s functioning.

6. Data Sharing

WeSwarm does not sell or rent personal data.

Data may be processed by:

  • Hosting providers
  • Technical service providers necessary to operate the installation

All service providers are required to maintain reasonable data security protections.

7. Data Security

We implement reasonable technical and organizational measures to protect data accessed via the Instagram Graph API, including:

  • Secure server environments
  • Encrypted connections (HTTPS)
  • Restricted access controls

However, no system is completely secure.

WeSwarm is not affiliated with or endorsed by Instagram or Meta unless otherwise stated.

10. Children’s Privacy

WeSwarm does not knowingly collect data from children under 13. If you believe such data has been processed, please contact us.

Data Deletion Policy (Instagram Graph API Compliance)

If you would like your Instagram data removed from WeSwarm systems, please follow the steps below:

How to Request Data Deletion

Send an email to: shelly AT totallylegit LLC dot com
 Subject line: “Data Deletion Request – WeSwarm”

Include:

  • Your Instagram username
  • A description of the content you wish removed
  • Proof that you are the account owner (if applicable)

What Happens Next

  1. We will confirm receipt of your request within 7 days.
  2. We will review and verify the request.
  3. Eligible data will be deleted from our systems within 30 days.
  4. You will receive confirmation once deletion is complete.

If data is cached temporarily, it will be removed during the next scheduled cache purge cycle.

Automatic Data Removal

If:

  • You revoke WeSwarm’s Instagram permissions via your Instagram settings, or
  • You delete your Instagram content

WeSwarm will no longer retrieve or display that content in future API calls.
